This Acceptable Use Policy (AUP) governs your use of the BuddyTalk.ai website, web application, APIs, WebSockets, and telephone-based AI voice friendship services (collectively, the “Service”), provided by Mobile Tech Media, LLC (“Mobile Tech Media,” “we,” “us,” or “our”). This AUP is incorporated into our Terms of Service and Privacy Policy. Capitalized terms have the meanings set forth there unless otherwise defined.
Purpose and Scope
This AUP is designed to protect users, our infrastructure, and the broader community from abuse, harm, and unlawful activity. It applies to anyone accessing or using the Service. You must be at least 18 years of age to use the Service.
Fair Use and Resource Limits
- Use the Service in good faith and within your plan’s limits. Excessive or abnormal usage that degrades performance, security, or availability may be rate-limited, suspended, or terminated.
- We may throttle calls, minutes, or concurrent sessions, or end calls that materially exceed limits or appear abusive.
Customer Accountability
- You are responsible for your account, your use of the Service, and any activity under your credentials, whether authorized by you or not.
- Keep your account secure (e.g., protect passwords, device access, and phone numbers used for verification).
Telephony and Messaging Rules
- Calling consent: We place outbound calls only to phone numbers you verify and consent to. Do not provide numbers you do not control.
- No robocalling/spam: Do not use the Service to send unsolicited or bulk calls or messages, or to evade applicable consent and Do Not Call rules.
- Caller ID integrity: Do not spoof or misrepresent caller identity.
- Emergency use: Do not use the Service for emergencies. If you are in danger, call your local emergency number (e.g., 911 in the U.S.).
- SMS texts: We may send service-related texts (e.g., verification, call reminders/status). Message and data rates may apply. You can opt out of non-essential texts by replying STOP; for help, reply HELP.
Prohibited Content and Conduct
You may not use the Service to generate, share, request, or facilitate any of the following:
- Illegal activity; promotion or facilitation of violence, terrorism, human trafficking, exploitation, or other crimes.
- Harassment, bullying, threats, hate speech, or content intended to demean or harm individuals or groups.
- Sexual content involving minors; sexual exploitation or non-consensual intimate content.
- Self-harm instructions or content that encourages suicide or serious harm. If you are in crisis, contact local emergency services.
- Medical, legal, or financial advice presented as professional advice. The Service is not a substitute for professional counsel.
- Fraud, deception, impersonation of others, identity theft, or attempts to obtain sensitive information without consent.
- Malware, phishing, or content that attempts to compromise security or privacy.
- Attempts to re-identify individuals from de-identified data, or to scrape or harvest personal data without lawful basis and consent.
- Reverse engineering, bypassing access controls, rate limits, or other technical restrictions; interfering with or disrupting the Service.
Privacy, Consent, and Third Parties
- Do not use the Service to record, transcribe, or monitor third parties without all legally required consents. Our Service does not store call audio; however, you remain responsible for any local recording you perform and for compliance with applicable laws.
- Do not disclose others’ personal or confidential information without permission, or in violation of law or rights of privacy or publicity.
- The Service is 18+ only. Do not attempt to use it with or on behalf of minors.
Network and Security Restrictions
- No DDoS, flooding, or actions that degrade or attempt to degrade infrastructure performance or availability.
- No unauthorized access, probing, scanning, or testing of our systems or networks, or those of our providers, without express written permission.
- Report suspected security issues responsibly to [email protected]. Do not exploit or publicly disclose vulnerabilities without a coordinated fix.
Export Controls and Sanctions
Do not use the Service in or for the benefit of sanctioned countries, persons, or entities, or in violation of applicable export control or sanctions laws.
Enforcement and Remedies
- We may investigate suspected violations and take action at our discretion, including warnings, filtering, rate-limiting, call blocking, suspension, or termination without refund where permitted by law and our Terms of Service.
- We may preserve and disclose information when required by law or to protect the rights, property, or safety of users, the public, or the Service.
Changes to This AUP
We may update this AUP from time to time. When we do, we will update the “Last Updated” date above. Your continued use of the Service after changes become effective constitutes acceptance of the updated AUP.
