Terms of Service for BuddyTalk.ai
These Terms of Service (“Terms”) govern your access to and use of the website located at https://buddytalk.ai and the related AI voice friendship services made available by Mobile Tech Media, LLC (“Mobile Tech Media,” “we,” “us,” or “our”).
By accessing or using BuddyTalk.ai, you agree to be bound by these Terms and our Privacy Policy and Acceptable Use Policy. If you do not agree, do not use the Service. You must be at least eighteen (18) years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the authority to enter into these Terms.

1. Description of the Service
BuddyTalk.ai provides AI-powered voice friendship accessible via telephone calls and a web dashboard for account management, scheduling, and billing (the “Service”). The Service enables inbound calls you place to our numbers and outbound calls that we place to your verified phone number based on your settings.
Important: The Service is not a medical, psychological, legal, or other professional service and is not intended for emergency or crisis situations. If you are in danger or experiencing a medical or mental health emergency, call your local emergency number (e.g., 911 in the U.S.) immediately. We do not provide therapy or counseling and we do not guarantee the accuracy, completeness, or reliability of AI‑generated content.
2. Accounts, Verification, and Eligibility
- You must create an account and provide accurate information. You agree to keep your contact details, including your verified phone number, current and accurate.
- Phone verification is required. We will place calls only to numbers you verify and consent to. Do not provide phone numbers you do not control.
- You may not share your account or allow others to use your account. You are responsible for all activities that occur under your account.
- You must be 18 or older to use the Service.
3. Calling Consent (TCPA), SMS Texts, and Scheduling
- By verifying your phone number and enabling outbound calls, you provide express consent for Service‑related calls to that number.
- Service‑related SMS/MMS: By verifying your phone number, you also consent to receive service‑related SMS/MMS messages (e.g., verification codes, call reminders/status, scheduling updates). Message and data rates may apply. You can opt out of non‑essential texts by replying STOP; for help, reply HELP. Transactional/authentication texts may be required to use certain features.
- Calls are service‑related (e.g., your AI friend, scheduling, call windows you configure). We do not place marketing calls or send marketing texts without separate consent. You may revoke consent by updating your settings or contacting support.
- You are responsible for setting accurate time zones and call windows. We will use commercially reasonable efforts to respect these windows but do not guarantee delivery times or availability.
4. No Audio Recordings; Conversation Summaries
We do not retain call audio recordings. Audio is processed ephemerally in real time to operate the Service and is not stored. We retain high‑level conversation summaries and structured “memories” to personalize future interactions. See our Privacy Policy for details.
Because we do not store call audio, we cannot later retrieve or provide audio recordings. Where appropriate, we may provide available summaries and call metadata.
5. Acceptable Use
You agree not to misuse the Service. Without limitation, you will not:
- use the Service for illegal, harmful, threatening, harassing, defamatory, hateful, or obscene purposes;
- attempt to exploit, harm, or collect data from minors (the Service is 18+ only);
- attempt to bypass safety systems, rate limits, or usage controls, or interfere with or disrupt the Service;
- engage in fraud, impersonation, or misuse of identity or payment methods;
- share others’ personal information without consent, or violate any applicable call consent or privacy laws;
- reverse engineer or attempt to extract source code or underlying models; or
- use the Service to provide professional advice (medical, legal, financial, etc.) or for emergency use.
Our Acceptable Use Policy is incorporated into these Terms. We may suspend or terminate accounts for violations.
6. Plans, Billing, and Taxes
- Subscriptions and usage are billed via Stripe. You authorize us and Stripe to charge your payment method for fees, taxes, and any recurring charges associated with your plan.
- Fees are generally non‑refundable except where required by law or as expressly stated during checkout. You may cancel at any time; access continues through the end of the current billing period unless stated otherwise.
- Mid‑cycle plan upgrades: If you upgrade your plan before the end of your current billing period, Stripe will apply a prorated credit for the unused portion of your current period toward your upgrade (based on the remaining days). Any remaining credit will be applied to subsequent invoices as an account balance. Downgrades typically take effect at the next renewal.
- We may offer usage limits. Approaching or exceeding limits may result in warnings, prompts to upgrade, temporary call restrictions, or termination of sessions. We may update plan features and pricing with notice for subsequent billing periods.
- You are responsible for all applicable taxes and fees, excluding our income taxes.
7. Service Availability and Changes
We may modify, suspend, or discontinue the Service (in whole or in part) at any time, including for maintenance, upgrades, or to address security concerns. We do not guarantee uninterrupted or error‑free operation and provide no service level agreements unless expressly stated in writing.
8. Content; Ownership; License
- You retain ownership of the inputs you provide to the Service. You grant us a worldwide, non‑exclusive, royalty‑free license to host, process, store conversation summaries and “memories,” and otherwise use your inputs as necessary to provide and improve the Service, to enforce these Terms, and to comply with law.
- You are responsible for your inputs and represent that you have all rights necessary to provide them and to grant the above license.
- AI‑generated outputs are provided “as is,” may be inaccurate or inappropriate, and are for informational and entertainment purposes. You are responsible for how you use outputs and for evaluating their accuracy for your use case.
9. Third‑Party Services
We integrate with third‑party providers to deliver the Service. Your use is also subject to their terms and policies where applicable.
10. Prohibited Uses and Enforcement
We may investigate and take action (including suspension or termination) if we believe you violate these Terms, the Acceptable Use Policy, or applicable law, or if your use poses risk to the Service or others. We may preserve and disclose information as required by law or to protect rights, property, and safety.
11. Suspension and Termination
We may suspend or terminate your access immediately for any violation of these Terms or the Acceptable Use Policy, for non‑payment, suspected fraud or abuse, or to comply with legal requirements. You may cancel at any time via your account (where available) or by contacting support. Upon termination, your right to use the Service ceases immediately, but certain sections (e.g., ownership, disclaimers, limitations of liability, indemnity, dispute resolution) will survive.
12. Disclaimers
- THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
- WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE, OR THAT DEFECTS WILL BE CORRECTED.
- AI‑GENERATED CONTENT MAY BE INACCURATE OR UNSUITABLE. YOU ARE RESPONSIBLE FOR YOUR RELIANCE ON ANY CONTENT AND FOR YOUR USE OF THE SERVICE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MOBILE TECH MEDIA, ITS AFFILIATES, OR THEIR LICENSORS OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY LAW.
14. Indemnification
You agree to indemnify, defend, and hold harmless Mobile Tech Media, its affiliates, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms or the Acceptable Use Policy; (c) your violation of law or any third‑party rights.
15. Intellectual Property; Feedback
The Service, including all software, interfaces, and branding, is owned by or licensed to Mobile Tech Media and protected by law. Except for the limited rights expressly granted to you, we and our licensors retain all rights, title, and interest. If you provide feedback, you grant us a non‑exclusive, perpetual, irrevocable, royalty‑free, worldwide license to use it without restriction or compensation.
16. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to our data practices as described therein, including our retention of conversation summaries and “memories,” and our non‑retention of call audio.
17. Compliance; Export; Sanctions
You represent that you are not located in, a resident of, or organized in an embargoed or comprehensively sanctioned country and are not on any government denied‑party list. You agree to comply with all applicable laws and regulations in connection with your use of the Service.
18. Changes to the Terms
We may update these Terms to reflect changes to the Service or legal requirements. When we do, we will update the “Last Updated” date above and, where required by law or where changes are material, provide additional notice. Continued use after changes become effective constitutes your acceptance of the updated Terms.
19. Governing Law and Venue
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict‑of‑laws principles. You irrevocably submit to the exclusive jurisdiction and venue of the state and federal courts located in Wyoming for any dispute arising out of or relating to these Terms or the Service.
20. General Terms
- Entire Agreement. These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and us regarding the Service.
- Severability. If any provision is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
- No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer without restriction.
- Notices. We may provide notices to you via the Service, email, SMS, or your account contact information.
